Bermuda takes its equivalence defense to Brussels and Paris

The island's premier is pressing Bermuda's case for regulatory cooperation and market access just as AM Best warns on collateral behind offshore life reinsurance.

At a glance

  1. Burt will speak at the Association of Bermuda Insurers and Reinsurers' 19th Annual International Insurance Regulatory Dialogue and at the Brussels Office annual reception, and in both capitals he is set to meet senior government, regulatory and business leaders.
  2. Equivalence is the kind of status that has to be re-earned as the rules underneath it move.
  3. Burt's itinerary reads as a defense of that argument: the meetings are a bid to keep European regulators and industry leaders inside Bermuda's equivalence rather than heading toward a framework that leaves the island on the outside.

David Burt, Bermuda's premier and finance minister, is spending the week in Belgium and France with an agenda built around the island's re/insurance industry, traveling with officials from the Ministry of Finance, Bermuda's Brussels Office and the London Office, according to a government spokeswoman; he is scheduled to return Sunday.

Burt will speak at the Association of Bermuda Insurers and Reinsurers' 19th Annual International Insurance Regulatory Dialogue and at the Brussels Office annual reception, and in both capitals he is set to meet senior government, regulatory and business leaders. The stated agenda — regulatory co-operation, market access, developments in the European financial services framework, deeper cooperation with European partners — reads like the standard Bermuda wish list; the occasion does not.

"As Bermuda marks ten years of equivalence with the EU Solvency II directive, this is a key milestone to reflect on the important role that Bermuda's insurance and reinsurance market plays in Europe and the global economy," Burt said.

Equivalence is the kind of status that has to be re-earned as the rules underneath it move. Days before the trip, AM Best flagged a collateral gap in offshore annuity reinsurance, warning that reserve credits are rising faster than the collateral backing them. As this publication has argued, offshore life cessions are the permanent-capital trade of this cycle, and the warning turns Bermuda's growth story into a capital-rules test: if the credits Europe's reinsurers are taking rely on collateral that is not keeping pace, the strongest argument for Bermuda's equivalence — a regime that protects policyholders — begins to fray.

Burt's itinerary reads as a defense of that argument: the meetings are a bid to keep European regulators and industry leaders inside Bermuda's equivalence rather than heading toward a framework that leaves the island on the outside. The deliverable to watch is whether the European financial services conversation over the next year absorbs Bermuda's market-access position — or moves past it.
