Two California data center bills advance despite industry pushback

State lawmakers move to keep the AI buildout from raising utility rates and pollution.

At a glance

  1. But the facilities are still being built and proposed across the state, and legislators are racing to keep them from pushing up utility rates and pollution.
  2. The advance recasts the data center argument as a statewide question about rates and air quality, not a local fight over one site.
  3. Industry objections are a signal of how much is at stake.

California isn't seeing the same influx of data centers as many other states; its sky-high electricity prices see to that, Canary Media reports. But the facilities are still being built and proposed across the state, and legislators are racing to keep them from pushing up utility rates and pollution. Two major data center bills have advanced despite industry pushback.

The advance recasts the data center argument as a statewide question about rates and air quality, not a local fight over one site. With the moves in the statehouse, the industry faces the prospect of binding rules that would apply to every megawatt of new capacity.

A ratepayer front

Industry objections are a signal of how much is at stake. A state that sets rate and pollution conditions for data centers controls the terms of its own AI buildout. California's power costs already stack the deck against new projects; legislation that hardens that advantage into law could cap the state's data center growth regardless of demand.

The final bills' language settles the outcome. The stricter the rate and pollution limits, the fewer projects will pencil out in California — and the more the buildout shifts to states with cheaper power and looser rules. For the rest of the country, the California debate is a first draft of the tradeoff every state will eventually have to make.
